СООТНОШЕНИЕ ЧАСТНОГО И ПУБЛИЧНОГО ИНТЕРЕСА В УГОЛОВНО-ПРАВОВЫХ СРЕДСТВАХ ОХРАНЫ ПУБЛИЧНЫХ ЗАКУПОК

В статье рассматривается характер средств уголовно-правовой охраны сферы публичных отношений в рамках ст. 200.4-200.6 УК РФ с позиции их социальной обусловленности. Автор отмечает, что, несмотря на частноправовой характер публичных закупок как таковых, общественные отношения, связанные с ними, отражают публичный интерес, который проявляется в самых разнообразных сферах.

The article examines the means of criminal law protection of public relations within the framework of Art. 200.4-200.6 of the Criminal Code of the Russian Federation from the standpoint of their social conditioning. The author notes that, despite the private law nature of public procurement as such, the public relations that are associated with them reflect the public interest that manifests itself in a wide variety of areas.
