ВЗАИМОСВЯЗЬ ИСКУССТВЕННОГО ИНТЕЛЛЕКТА КАК СРЕДСТВА СОВЕРШЕНИЯ ПРЕСТУПЛЕНИЯ И ИНЫХ ОБЪЕКТИВНЫХ ПРИЗНАКОВ СОСТАВА ПРЕСТУПЛЕНИЯ

В статье рассматривается влияние искусственного интеллекта как средства совершения преступления на объект и объективную сторону состава преступления. В связи с отсутствием нормативно-правовой базы и судебной практики, связанной с пониманием искусственного интеллекта как средства совершения преступления, в качестве примеров в статье рассматриваются смоделированные ситуации, приближенные к реальности. Анализ взаимосвязи искусственного интеллекта как средства совершения преступления с объективной стороной состава преступления проведен через призму существующих статей Уголовного кодекса РФ, по которым с большей степенью вероятности будет использоваться искусственный интеллект как средство совершения преступления. В статье подводятся выводы относительно взаимосвязи искусственного интеллекта и объективной стороны составов рассмотренных преступлений и выносятся предложения относительно дальнейшего развития и закрепления данного вопроса в Уголовном кодексе РФ

The article considers the influence of artificial intelligence as a means of committing a crime on the object and the objective side of the corpus delicti. Due to the lack of a regulatory framework and judicial practice related to the understanding of artificial intelligence as a means of committing a crime, the article considers simulated situations that are close to reality as examples. The analysis of the relationship of artificial intelligence as a means of committing a crime with the objective side of the crime is carried out through the prism of existing articles of the Criminal Code of the Russian Federation, according to which artificial intelligence is more likely to be used as a means of committing a crime. The article provides conclusions regarding the relationship between artificial intelligence and the objective side of the corpus delicti, and makes proposals for the further development and consolidation of this issue in the Criminal Code of the Russian Federation
