Вопросы экологического сотрудничества в рамках Восточноафриканского сообщества (ВАС)

Защита окружающей среды и природных ресурсов в рамках Восточноафриканского сообщества (ВАС) является важным аспектом в деятельности Сообщества. Хотя у государств-членов ВАС разные темпы развития, но они стремятся к совместному решению экологических проблем, что отражено в одной из основных целей Договора Сообщества: содействие устойчивому использованию природных ресурсов государств-членов и принятие мер, которые будут эффективно защищать природную среду Сообщества (ст. 5(3с)). Восточноафриканское сообщество имеет огромные природные национальные парки, леса и водоемы (например, озеро Виктория, которое является крупнейшим озером в Африке по площади). Эти объекты флоры и фауны испытывают негативный эффект от антропогенной деятельности (ведение сельского хозяйства, рыболовство, добыча полезных ископаемых, индустриализация и производство, урбанизация). В статье рассмотрены существующие международно-правовые механизмы защиты и сохранения окружающей среды в рамках ВАС и сделан вывод о поступательном развитии данного направления сотрудничества.

Jurisdiction of the East African Community in the sphere of Environment

The Protection of the environment and natural resources within the East African Community (hereinafter the EAC) is an important aspect of the community. Although the partner states have different paces with which they solve problems related to this issue, it is a fundamental objective of the EAC under article 5(3c) of the EAC Treaty to “promote sustainable utilisation of the natural resources of the Partner States and to take measures that will effectively protect the natural environment of the Partner States”. The community boasts vast natural national parks, forests and water bodies for example the Lake Victoria which is the largest lake in Africa in terms of area covered. These natural flora and fauna call for the attention of the community for maintenance and protection against human and non human activities that may arise from the modern processes of development towards economic integration. These activities include farming, fishing, mining, industrialization and manufacturing, urbanization. These activities have been discussed in the article. The article also points out some of the serious threats to the environment within the EAC, some of which have been addressed while others remain as separate cases in the individual partner states. For example, a successful case law was brought before the East African Court of Justice which ruled in favor of protecting the Serengeti national park in Tanzania. This case law has also been mentioned in the article.
