Культурно-исторический контекст как фактор формирования моделей разграничения предметов ведения и полномочий между федеральным центром и субъектами федерации

В статье рассматриваются модели разграничения предметов ведения и полномочий меду федеральным центром и субъектами федерации сквозь призму культурно-исторических особенностей развития государств. В сравнительно-правовом аспекте анализируется опыт федеративного государственного устройства и разграничения предметов ведения и полномочий в США, ФРГ, Индии, Австрии и Бельгии. Сравнение реализуется по степени и характеру соотношения централизационных и децентрализационых тенденций в организации и функционировании государственного механизма в этих странах. Особое внимание уделено способам ограничения полномочий субъектов федерации и инструментам централизации и политической интеграции в современных федеративных государствах. В статье делается вывод о том, что общей тенденцией в современных федерациях является расширение полномочий федерального центра, а ключевым основанием для выбора модели разграничения предметов ведения и полномочий является инструментальная роль, которую федеративное устройство выполняет по отношению к конкретному обществу.

Cultural and historical context as a factor of formation of models of differentiation of areas of jurisdiction and powers between the federal center and territorial subjects of the federation

The present article is dedicated to the models of differentiation of areas of jurisdiction and powers between the federal center and territorial subjects of the federation, being analyzed from the point of view of the cultural and historical specifics of the development of the states. In comparative legal aspect the experience of federal state system and differentiation of areas of jurisdiction and powers in the USA, Germany, India, Austria and Belgium is analyzed. The comparison reveals the degree and character of centralization and decentralization tendencies in the organization and functioning of the state mechanism in these countries. Special attention is paid to the ways of limitation of powers of territorial subjects of the federation as well as to the instruments of centralization and political integration in contemporary federal states. The conclusion made in the article drives to the general tendency in contemporary federations - the expansion of powers of the federal center, as well as to the issue that the key basis for the choice of model of differentiation of areas of jurisdiction and powers is the instrumental role which the federal organization plays in relation to the particular society.
