Преобразование традиционных основ власти исламской правовой мыслью

Статья посвящена анализу мнений ученых относительно эволюции доктринальных основ государства с точки зрения исламской правовой науки. Дается общее описание отхода правовой науки ислама от средневекового (классического) подхода понимания государства и власти в исламе, приводится описание сложившейся на сегодняшний день позиции исламских ученых относительно источников государственной власти, связанных с этим спором. Освещаются назревшие за последние полвека точки зрения отечественных и зарубежных ученых по данному вопросу, дается попытка выведения на основании имеющихся выводов ученых и позиции исламской правовой науки общих принципов формирования и функционирования исламского государства и власти в исламском мире.

The article is devoted to the analisis of the opinions of scientists regarding evolution of the doctrinal foundations of the state from the point of view of Islamic legal science. A general description is given of the departure of Islamic legal science from the medieval (classical) approach to understanding the state and power in Islam, a description is given of the current position of Islamic scholars regarding the sources of state power and the disputes associated with this. The points of view of domestic and foreign scholars on this issue that have matured over the past half century are highlighted, an attempt is made to derive, on the basis of the existing conclusions of scholars and positions of Islamic legal science of the general principles of the formation and functioning of the Islamic state and power in the Islamic world.
