Стадии ликвидации кредитной организации: некоторые прикладные правовые вопросы

Настоящая статья рассматривает правовые вопросы добровольной ликвидации кредитной организации. В статье рассматриваются основные стадии добровольной ликвидации кредитной организации и предлагаются пути совершенствования правового регулирования для обеспечения максимально эффективного взаимодействия ликвидационной комиссии ликвидируемой кредитной организации и надзорного органа в лице Банка России. Так, в целях оптимизации административной процедуры автором предлагается установить квалификационные требования к членам ликвидационной комиссии и нормативно закрепить основания для отказа в согласовании отдельных членов ликвидационной комиссии, повысить роль официального сайта кредитной организации, сделав последний основным источником информации о ходе ликвидации, сократить сроки рассмотрения заявлений по согласованию балансов и принятию решения о государственной регистрации ликвидации кредитной организации, прописать порядок уничтожения печатей кредитной организации и ликвидационной комиссии кредитной организации.

The article reveals the legal issues of the voluntary liquidation of the credit organization. The article is devoted to review of the main stages of the voluntary liquidation of the credit organization and the solutions of legal development of the Russian legislation are proposed in this article in order to ensure the effective collaboration between the liquidation committee of the liquidated credit organization and the Bank of Russia. For the purposes of optimization of the administrative process the author suggests to set up the qualification requirements for the members of the liquidation committee of the credit organization and legally set out the grounds for Bank of Russia’s refusal to approve the candidates to the liquidation committee of the Bank, to increase the influence of the official website of the liquidated entity as an official source of liquidation process, to cut off the terms of review of the liquidation balances, application for registration of the liquidation of the banks, to set up the procedure of the deletion of the corporate seals of the liquidation committee and of the Bank.
