ОСОБЕННОСТИ РЕАЛИЗАЦИИ ГОСУДАРСТВЕННОЙ АНТИКОРРУПЦИОННОЙ ПОЛИТИКИ В СОВРЕМЕННОЙ РОССИИ: МЕХАНИЗМ ГОСУДАРСТВЕННОГО КОНТРОЛЯ В КОНТРАКТНОЙ СИСТЕМЕ ГОСУДАРСТВЕННЫХ ЗАКУПОК

В статье поднимаются вопросы теории и практики государственного контроля за госзакупками. С каждым годом в законодательство о закупках вносится существенное количество изменений, принимаются подзаконные акты (более 130), ужесточается наказание за нарушение в сфере госзакупок, изменяются механизмы контроля, расширяются полномочия контрольных органов, законодательство стремится регламентировать все стороны процессов закупок в рамках Закона о контрактной системе. Вместе с тем приводящиеся экспертно-аналитические мероприятия и публикующиеся результаты мониторингов и отчетов различных органов власти показывают низкие показатели конкурентности и эффективности государственных закупок. В этих условиях встает вопрос об эффективности функционирования, как самих закупок, так и системы контроля за ними. В этой связи, особое внимание автора уделено вопросам функционирования системы государственного контроля за закупками в настоящее время и на основе проведенного анализа выявлены соответствующие проблемные точки. Очевидно, что существуют особенности осуществления государственного контроля, которые пока что не позволяют в должном объеме обеспечить снижение показателей уровня коррупции в госзакупках и которые рассматриваются в данной статье. Между тем система государственных закупок аккумулирует значительные экономические ресурсы и способна оказать существенное влияние на развитие государства и общества в целом. Вопросы повышения эффективности ее функционирования являются первостепенной задачей целенаправленной политики государства в системе контрактных отношений как залога развития экономики страны и реализации национальных программ.

FEATURES OF IMPLEMENTATION OF STATE ANTI-CORRUPTION POLICY IN MODERN RUSSIA: MECHANISM OF STATE CONTROL IN CONTRACT SYSTEM OF PUBLIC PROCUREMENT

The article raises issues of theory and practice of state control over public procurement. Every year, a significant number of amendments are made to the procurement legislation, by-laws are adopted (more than 130), penalties for violations in the sphere of public procurement are increased, control mechanisms are changed, the powers of control bodies are expanded, the legislation seeks to regulate all parties to procurement processes within the framework of the Law on the Contract System. At the same time, the expert and analytical activities and published results of monitoring and reports of various authorities show low indicators of competitiveness and efficiency of public procurement. In this context, the question arises as to the effectiveness of the operations, both of the procurement itself and of the system for monitoring them. In this regard, the author's special attention is paid to the functioning of the system of State control over procurement at present and, on the basis of the analysis carried out, the relevant problem points have been identified. It is obvious that there are peculiarities of state control, which do not yet allow to ensure proper reduction of indicators of corruption in public procurement, which are considered in this article. Meanwhile, the public procurement system accumulates significant economic resources and has the potential to have a significant impact on the development of the State and society as a whole. Issues of improving the efficiency of its functioning are the primary task of the targeted policy of the State in the system of contract relations as a guarantee of the development of the economy of the country and the implementation of national programs.
