В настоящей статье рассматривается практика Европейского Суда по правам человека в отношении некоторых аспектов экстратерриториального осуществления юрисдикции государствами-членами Европейской Конвенции о защите прав человека и основных свобод 1950 г. в свете вопроса о присвоении ответственности за нарушения этого договора. Отмечено, что практика указанного судебного органа создаёт правовую неопределённость и способствует фрагментации международного публичного права. Предлагается присваивать поведение государству по международному праву наряду с установлением Европейским Судом по правам человека фактов осуществления юрисдикции и нарушения обязательства в целях решения указанных проблем.
The current article examines practice of the European Court of Human rights in respect of certain aspects of exercise of extraterritorial jurisdiction by the States parties to the European Convention of Human Rights and Fundamental Freedoms in light of attribution of responsibility of States parties to that treaty. It is stated that the practice of the designated court creates legal uncertainty and contributes to fragmentation of public international law. It is proposed to attribute conduct to a State under international law along with the establishment by the European Court of Human Rights of the facts of exercise of extraterritorial jurisdiction and a breach of an obligation, with the view of solving the designated problems.
