Концепция минимальных стандартов защиты прав усыновленных детей в международно-правовых документах (Выражение стандартов защиты прав ребенка в Конвенции ООН 1989 г.)

В статье рассматриваются основные положения Конвенции ООН о правах ребенка и ряд международных соглашений, принятых в развитие положений об усыновлении, в том числе международного усыновления. Современная система международной охраны ребенка и защиты его прав сформировалась в рамках Организации Объединенных наций, как составная часть международной защиты прав человека. За последние 50 лет были разработаны и скорректированы международные соглашения, которые регулируют динамично меняющуюся ситуацию в сфере усыновления и те серьезные проблемы, которые в этой связи возникают. Конвенция о правах ребенка является в настоящее время основным нормативным документом по вопросам усыновления в общемировом масштабе, которая закрепляет базовые стандарты защиты прав детей при усыновлении, включая и трансграничное усыновление.

The concept of minimal standards for protecting the rights of adopted children in international legal documents (Expression of standards for the protection of the rights of the child in the 1989 UN Convention)

The article discusses the main provisions of the UN Convention on the Rights of the Child and a number of international agreements adopted in the development of provisions on adoption, including international adoption. The modern system of the international protection of the child and the protection of his rights has been formed within the framework of the United Nations as an integral part of the international protection of human rights. Over the past 50 years, international agreements have been developed and adjusted that regulate the dynamically changing situation in the field of adoption and the serious problems that arise in this regard. The Convention on the Rights of the Child is currently the main regulatory document on adoption worldwide, which establishes basic standards for the protection of the rights of children during adoption, including cross-border adoption.
