Principles of digitalization of legal proceedings in civil cases and economic disputes

The active development of information technologies and their implementation in all spheres of public relations implies a significant transformation of the procedure of legal proceedings in civil cases and economic disputes. However, given the rapid pace of digital development, regulatory changes are often hasty and not always well thought out. In this regard, there is a need to not just analyze the existing and expected adjustments to the normative material, but alsoform the theoretical basis for the modernization of law in the era of digitalization. This article is devoted to the identification and content analysis of the digitalization principles of one of the most important branches – civil procedure law – and the actual legal proceedings in civil cases and economic disputes. Based on the doctrine, legislation, and law enforcement practice, the authors identify the basic conceptual principles of informatization of the civil process. They justify the need to use advanced information technologies in legal proceedings in strict accordance with the traditional institutions of the Russian civil and arbitration process. © 2020, Institute of Advanced Scientific Research, Inc..
