Актуальность темы исследования обусловлена целесообразностью ужесточения контроля добычи и рационального использования ценных биоресурсов, которые обладают устойчивым спросом в международной торговле и являются валютоемкими товарами. Авторами проведен анализ основных положений Конвенции о международной торговле видами дикой фауны и флоры, находящимися под угрозой исчезновения, СИТЕС, а также Федерального закона «О рыболовстве и сохранении водных биологических ресурсов». Проведен анализ судебной практики, по результатам которого выявлены недостатки действующего механизма выполнения требований законодательства о рыболовстве, что не способствует сохранению водных биологических ресурсов.По мнению авторов, совершенствование системы государственного регулирования и государственного контроля рыболовецкой отрасли должно быть направлено на ужесточение контроля добычи и перемещения водных биоресурсов с учетом установленных квот и повышение эффективности таможенного контроля экспорта водных биоресурсов, путем внесения соответствующих изменений в нормативные правовые документы.
The relevance of the research topic is determined by the expediency of tightening the control of production and rational use of valuable biological resources, which have a stable demand in international trade and are currency- intensive goods. The authors analyzed the main provisions of the Convention on international trade in endangered species of wild fauna and flora, CITES, as well as the Federal law "On fisheries and conservation of aquatic biological resources". The analysis of judicial practice, the results of which revealed the shortcomings of the current mechanism of compliance with the requirements of legislation on fisheries, which does not contribute to the conservation of aquatic biological resources.According to the authors, the improvement of the system of state regulation and state control of the fishing industry should be aimed at tightening the control of production and movement of aquatic bioresources, taking into account the established quotas and improving the efficiency of customs control of exports of aquatic bioresources, by making appropriate changes to regulatory legal documents.
