Роль советов старейшин и советов биев в системе правосудия Российской Федерации и Республики Казахстан

Рассматриваются традиционно-правовые институты системы правосудия в Российской Федерации и Республики Казахстан. По-новому дается оценка традиционным регуляторам в развитии судебной системы этих стран. Отмечается необходимость понимания того факта, насколько социально оправданным является процесс внедрения советов старейшин и советов биев в современную правовую систему. Анализируются причины возрождения совета биев в Казахстане, этапы исторического развития советов старейшин и биев, взаимоотношения данных органов с другими институтами власти.

The article discusses traditional legal institutions of the justice system in the Russian Federation and the Republic of Kazakhstan. There is given a new assessment in respect to the traditional regulators in the development of the judicial system of the stated countries. The aim of the article is to provide an understanding of the fact how socially justified is the process of the introduction of the council of elders and biys in Kazakhstan as well as how the introduction of such practice might contribute to the improvement of the present state law. The article discusses reasons of the revival of the council of biys in Kazakhstan, stages of the historical development of the council of elders and biys, relationship of these bodies with other institutions of power.
