"КОДИСТИКА" (УЧЕНИЕ О ТЕХНИКЕ КОДИФИКАЦИИ) В МЕЖДУНАРОДНОМ ПРАВЕ

В статье исследуется феномен кодистики - учения о технике кодификации международно-правовых норм. Вначале дается небольшой экскурс в историю становления кодистики и развития кодификаторской традиции в доктрине международного права. Далее рассматриваются общие положения международно-правовой кодистики: определяются понятие кодификации, цели и принципы кодификационной деятельности, различные виды и уровни кодификации международного права. В завершающей части статьи анализируются специальные правила и методика кодификации на примере международного уголовного права: этапы кодификационной процедуры, приемы внешнего оформления кодификационных актов, элементы структуры этих актов и логико-языковое построение их норм, условия и порядок вступления в силу. ●

"Codistics" (Doctrine of Codification Technique) in International Law

The article is devoted to the phenomenon of codistics - codification technique doctrine of international legal norms. In the beginning the author gives a short digression to the history of formation of codistics and development of codification tradition in the international law doctrine. Then general provisions of international law codification are considered: concept of codification, purpose and principles of codification activity, various types and levels of international law codification. In the final part of the article special rules and methods of codification are analyzed by examples of international criminal law: stages of codification procedure, ways of external registration of codification acts, elements of the structure of these acts and logical-language construction of their norms, conditions and order of coming into force. ●
