ОБЗОР НОВОЙ РЕДАКЦИИ ГПК КНР ОТ 24 ДЕКАБРЯ 2021 ГОДА

В статье дан обзор новой редакции ГПК КНР от 24.12.2021, а также «Регламента онлайн судебных разбирательств народного суда» КНР от 16.06.2021. Поправки к ГПК КНР 2021 г. представляют собой законодательное закрепление практики отдельных судов КНР, работающих по Пилотной программе 2019 г. (Интернетсуды в Ханчжоу, Пекине и Гуанчжоу). Недавние изменения в ГПК КНР направлены на сокращение рабочей нагрузки судей и упрощение судебной процедуры путем продвижения онлайн-судебных разбирательств, расширения сферы применения судебных разбирательств с участием одного судьи, сокращения числа дел во второй инстанции и поддержки медиации.

REVIEW OF THE NEW EDITION OF THE CPC OF THE PEOPLE'S REPUBLIC OF CHINA DATED DECEMBER 24, 2021

Amendments to the CPC of 2021 represent the legislative consolidation of the practice of individual courts of the People's Republic of China operating under the Pilot Program of 2019 (Internet courts in Hangzhou, Beijing and Guangzhou). Recent changes in the CPC of the People's Republic of China are aimed at reducing the workload of judges and simplifying the judicial procedure by promoting online litigation, expanding the scope of single-judge litigation, reducing the number of cases in the second instance and supporting mediation.
