Man as subject of law in the light of post-non-classical science: Essence of i homo informaticus

The article deals with the nature of man as the subject of law through the prism of the classical, post-classical and post-non-classical types of scientific rationality. This study of the conceptual status of the subject of law in the framework of the above paradigms of scientific rationality is motivated by the desire to show first the authors' scientific dynamics of change in the number of features set in the modern era, and then to describe trends in the transformation of the epistemological horizon in the study of its qualitative nature in the postmodern period. The article explores the nature of the concept of "the subject of law" first in its classical and post-classical vision and understanding, then from the angle of information and cognitive synergy and quantum approaches. The proposed approaches to understanding the legal picture of the world are developed in accordance with one of the post-non-classical epistemological lines in which the spiritual essence of "I" homo informaticus constitutes the categorical matrix. The paper argues that Homo informaticus as me subject of law is an open non-equilibrium system of the individual, which is a nonlinear hierarchy of self-organizing information structures, namely legal quasi pattern, legal proto pattern, and judicial pattern, that are formed as a result of "fusion". © 2017 International Information Institute.
