РОЛЬ КОНСТИТУЦИОННОГО СУДА В ЗАЩИТЕ ГОСУДАРСТВЕННЫХ СРЕДСТВ СРАВНИТЕЛЬНОЕ ИССЛЕДОВАНИЕ ИРАКА И РОССИИ

Данная научная статья представляет сравнительный анализ роли Конституционного суда в защите государственных денег в Ираке и России. Авторы исследуют основные функции и полномочия Конституционных судов обеих стран в контексте обеспечения конституционности финансового управления и защиты государственных средств. Статья обращает внимание на контроль конституционности законов и нормативных актов, рассмотрение конституционных жалоб и споров, а также роль Конституционного суда в сфере бюджетного процесса. С помощью сравнительного подхода авторы исследуют сходства и отличия в правовых институтах и процедурах, используемых в Ираке и России для защиты государственных средств. Авторы также обращают внимание на консультативные функции Конституционных судов и их вклад в обеспечение единообразия и стабильности правоприменительной практики в области финансового обеспечения государства. В исследовании делается вывод, что роль конституционных судов в защите государственных средств как в России, так и в Ираке в чем-то схожа, принципиальным отличием является возможность вмешательства Конституционного суда Ирака в мониторинг процесса подготовки бюджета, тогда как такая роль отсутствует. от конституционного суда России.

This scientific article presents a comparative analysis of the role of the Constitutional Court in protecting public money in Iraq and Russia. The authors explore the main functions and powers of the Constitutional Courts of both countries in the context of ensuring the constitutionality of financial management and protection of public funds. The article draws attention to the control of the constitutionality of laws and regulations, consideration of constitutional complaints and disputes, as well as the role of the Constitutional Court in the field of budgetary process. Using a comparative approach, the authors explore the similarities and differences in the legal institutions and procedures used in Iraq and Russia to protect public funds. The authors also draw attention to the advisory functions of the Constitutional Courts and their contribution to ensuring uniformity and stability of law enforcement practice in the field of state financial support. The study concludes that the role of the constitutional courts in protecting public funds in both Russia and Iraq is somewhat similar, the fundamental difference being the possibility of interference by the Constitutional Court of Iraq in monitoring the budget preparation process, whereas there is no such role. from the Constitutional Court of Russia.
