Научные подходы к "образовательному праву" в Российской Федерации: понятие, структура

В настоящей статье исследуются различные подходы к определению понятия«образовательное право» в широком смысле, а именно - образовательное право как:1) комплексная отрасль права; 2) нормативно-правовой массив (образовательное законодательство); 3) совокупность образовательных прав, обязанностей и гарантий участников образовательных отношений; 4) учебная дисциплина. Определяется место образовательного права в системе российских отраслей права. Кроме того, в данной статье исследуется структура образования, которая определяется, по мнению авторов, через систему образования. Система образования в свою очередь состоит из подсистем образования.

Scientific approaches to the "educational law" in Russian Federation: definition, structure

The article examines different approaches to the definition of the concept of educational law in a broader meaning. Educational law is regarded as 1) a comprehensive branch of the law; 2) a legal and regulatory array (educational legislation); 3) a range of educational rights, obligations and guarantees of participants in the educational relations; 4) an academic discipline. The article consists of determination of the place of educational law in the system of Russian branches of law. In addition, according to the authors, this article explores the structure of education which is determined through the system of education - a set of relations among the entities of the educational process. The education system consists of education subsystems.
