Авторы подробно исследуют проблемы субъективной стороны преступлений, предусмотренных ст. 230.1 УК РФ и 230.2 УК РФ. Особо обращается внимание на необходимость указания на цель совершения этих преступлений. Например, такое законодательное решение содержится в уголовном законодательстве ФРГ и Италии. На основе проведенного анализа авторы предлагают отредактировать данные уголовно-правовые нормы, руководствуясь следующим: поскольку причинить вред отношениям честной конкуренции в спорте могут только такие действия, которые связаны со склонением спортсмена к использованию и использованием в отношении спортсмена субстанций и (или) методов, запрещенных для использования в спорте, постольку они могут совершаться только с целями: а) увеличения конкурентоспособности спортсмена во время спортивных соревнований за счет применения им или использования в отношении него запрещенных в спорте субстанций и (или) методов; б) оказания влияния на результат спортивных соревнований за счет применения им или использования в отношении него запрещенных в спорте субстанций и (или) методов. Соответственно такая цель совершения преступлений, предусмотренных ст. 230.1 УК РФ и 230.2 УК РФ, должна, по мысли авторов, быть отражена в диспозиции данных уголовно-правовых норм.
The authors examine the problem of the mental element in crime stipulated by the article 230.1 and 230.2 of the criminal code of the Russian Federation. The author especially draws attention to the need for specifying the purpose of committing these crimes. For example, such a legislative solution is contained in the criminal legislation of Germany and Italy. On the basis of the conducted analysis, the authors propose to amend this criminal law on the basis of the following: as to harm the relations of fair competition in sport may only such actions which are associated with inducing the athlete to use and use in the athlete substances and (or) the methods prohibited for use in sport, in so far they may only be committed with the following purposes: a) increase of competitiveness of the athlete during sport competitions through the use of them or use against him of prohibited substances and (or) methods; b) influence on the outcome of sports competitions through the use of him or the use of substances and (or) methods prohibited in sport in relation to him. Therefore, this purpose of committing crimes under Art. 230.1 of the Criminal Code of the Russian Federation and 230.2 of the Criminal Code of the Russian Federation, in the opinion of the authors, shall be reflected in the disposition of this criminal law.
