Соотношение принципа свободы договора и антимонопольного ограничения права на отказ от заключения договора в законодательстве России, США и ЕС

Статья рассматривает проблему соотношения принципа свободы договора и антимонопольного ограничения права на отказ от заключения договора в различных юрисдикциях. Проводится анализ антимонопольного законодательства России, США и ЕС, выявляются различия применяемых подходов и оценивается их эффективность. Делается вывод о том, что свобода договора монополистов в отечественном антимонопольном законодательстве значительно более ограниченна, чем в западных странах, что, вероятно, связано с более низким развитием рыночной экономики в России по сравнению с США и ЕС.

The Correlation of the Freedom of Contract and the Duty to Deal under the Russian, US and EU Competition Laws

The article looks into the correlation of the freedom of contract and the duty to deal under the Russian, US and EU competition laws. Current competition rules of the named jurisdictions are analyzed, the differences in the approaches applied are determined and the effectiveness of the approaches is evaluated. The conclusion is made that the duty to deal under the Russian antimonopoly law is much wider as well as the freedom of contract is much more limited as compared to the western antitrust policy, which probably results from the poor development of the market economy in the Russian Federation.
