Способы защиты прав акционеров в праве Российской Федерации и Азербайджанской Республики

В настоящей статье рассматриваются способы защиты прав акционеров в праве Российской Федерации и Азербайджанской Республики. Автор выделяет две основные формы защиты прав акционеров - юрисдикционную и неюрисдикционную, каждая из которых состоит из отдельных способов защиты. Также исследуются положения законодательства, судебной практики и доктрины рассматриваемых стран в контексте способов защиты прав акционеров, а основное внимание автор уделяет сравнительно-правовому аспекту.

Ways of the shareholders’ rights protection in the law of the Russian Federation and the Republic of Azerbaijan

This article touches upon the ways of the shareholders’ rights protection in the law of the Russian Federation and the Republic of Azerbaijan. The author distinguishes two basic forms of the shareholders’ rights protection - jurisdictional and unjurisdictional, each of which consists of individual protection ways. Within the framework of this article the provisions of the legislation, court practice and the legal doctrine of the considered countries in the context of the ways of the shareholders’ rights protection are analyzed, focusing primarily on the comparative legal aspect.
