Трансформация реализации принципов охраны здоровья граждан в Российской Федерации: организационный и финансово-правовой аспект

Цель исследования - провести анализ нормативно-правовой базы и научных источников, посвященных принципам охраны здоровья граждан и трансформации их реализации на современном этапе. Материалы и методы. Проведен анализ юридической литературы, нормативных правовых актов по вопросам охраны здоровья граждан в Российской Федерации. Для реализации поставленных целей использовались методы библиографического поиска источников в различных базах данных. В публикации представлен анализ нормативно-правовой базы принципов охраны здоровья населения в историческом аспекте. Результаты исследования выявили соответствующие проблемы недостаточного финансирования отрасли, нерационального использования и недостаточного правового контроля расходования ресурсов. Заключение. В настоящее время принципы, основы и гарантии в здравоохранении представлены прежде всего в Конституции РФ, затем - в международных документах в непротиворечащей части, федеральных законах, законах субъектов РФ и иных нормативно-правовых актах. Однако с учетом предстоящего увеличения финансирования системы здравоохранения в целях повышения доступности и улучшения качества медицинской помощи для населения, увеличением ожидаемой продолжительности жизни требуется совершенствование правового контроля государственного финансирования системы здравоохранения в РФ.

The aim of the study is to analyze the legal framework and scientific sources on the principles of protecting the health of citizens and the transformation of their implementation at the present. Materials and methods. The analysis of the legal literature, normative legal acts on the issues of protecting the health of citizens in the Russian Federation was carried out. To achieve the goals set, the methods of bibliographic search of sources in various databases were used. The publication presents an analysis of the legal framework of the principles of public health protection in the historical aspect. The results of the study revealed the corresponding problems of insufficient financing of the industry, irrational use and insufficient legal control over the expenditure of resources. Conclusion. At present, the principles, foundations and guarantees in healthcare are presented first by the Constitution of the Russian Federation, then - in international documents in a non-contradictory part, federal laws, laws of the constituent entities of the Russian Federation and other regulatory legal acts. However, taking into account the forthcoming increase in financing of the healthcare system in order to increase the availability and quality of medical care for the population, the increase in life expectancy, it is necessary to improve the legal control of financing of the healthcare system in the Russian Federation.
