THE INTERNATIONAL HUMANITARIAN LAW BETWEEN THE NECESSITY OF INTERVENTION AND THE CHALLENGES OF ENFORCEMENT

The many principles on the basis of which the international community tried to limit war and the means by which it sought to use them to resolve disputes between states, did not actually lead to the disappearance of war from human life, but rather increased its ferocity and multiplied the number of its victims in contemporary history as a result of the development of weapons and the emergence of alliances that it led to the outbreak of world wars that threaten the future of all mankind. In an attempt to confront this failure to implement the law of war within international law, there has become an urgent need to develop and strengthen the rules for regulating armed conflicts by reviewing the provisions of the law to keep pace with the necessities and challenges of each era and trying to free it from the political influences that have always played a negative role in disrupting it. The research includes an analysis of the importance of international humanitarian law, its scope, applications and the most important factors affecting its enforcement.
