РАЗВИТИЕ ПРЕДСКАЗАННОГО ПРАВОСУДИЯ: ОПЫТ США

В рамках исследования цифровизации правосудия, судебного разбирательства рассматривается развитие предсказанного правосудия в США. Предсказанное правосудие в США получило наибольшее развитие и располагает яркими примерами, например системы предсказанного правосудия Ravel Law, Casetext, Legal Analytics Platform. В статье исследуются примеры систем предсказанного правосудия, их детальное функционирование, особенности и ключевые функции. В частности, системы предсказанного правосудия представляют существенную значимость для судебных юристов, позволяя прогнозировать разрешение спора благодаря получению статистических данных об удовлетворении иска у конкретного судьи, также срок рассмотрения ходатайств, процент удовлетворения заявлений представителя оппонента и т.д. Авторы оценивают высокий уровень развития предсказанного правосудия в США и обращают внимание на сложную технологическую составляющую данных систем. В статье отмечается эффективность и технологичность российской судебной системы с задатками к созданию и дальнейшему развитию систем предсказанного правосудия.

As part of the study of the digitalization of justice, the trial examines the development of predict courts' decisions in the United States. The article examines examples of predict courts' decisions systems, their detailed functioning, features and key functions. In particular, the predict courts' decisions systems are of significant importance for trial lawyers, allowing them to predict the resolution of a dispute by obtaining statistical data on the approval of a claim from a particular judge, the period of consideration of petitions, the percentage of approval of statements by an opponent's representative, etc. The authors assess the high level of development of predict courts' decisions in the United States and pay attention to the complex technological composition of these systems. The article notes the efficiency and technological effectiveness of the Russian judicial system with the makings for the emergence and further development of systems of predict courts' decisions.
