TERRORISMO: UNA NOCION ANFIOBIOLOGICA

El escrito plantea que las definiciones sobre el terrorismo vigentes en América Latina (especialmente en Colombia) son vagas y anfibológicas, pues no hay claridad sobre los actos que pueden considerarse terroristas, no diferencian a los “terroristas” de los perpetradores de otros tipos de violencia ni tienen en cuenta el objetivo de la violencia. Esta situación provoca serios problemas políticos y jurídicos porque la normatividad y los discursos antiterroristas se convierten en un mecanismo de estigmatización de los opositores políticos legales. En última instancia, el entramado jurídico desplegado por los Estados para enfrentar la amenaza terrorista termina rompiendo el ordenamiento jurídico y democrático que afirma defender.

TERRORISM: AN ANOFIOBIOLOGIC NOCION

The paper argues that the definitions of terrorism in Latin America (especially in Colombia) are vague and amphibological, since there is no clarity about the acts that can be considered terrorism, do not differentiate “terrorists” from perpetrators of other types of violence and do not take into account the objective of such violence. This situation causes serious political and legal problems because normative and anti-terrorist discourses become a mechanism for stigmatizing legal political opponents. Ultimately, the legal framework deployed by States to confront the terrorist threat ends up breaking the legal and democratic legal system that it claims to defend.
