К вопросу о необходимости законодательной регламентации исследования доказательств как полнозначного этапа процесса доказывания

В данной статье приводится обоснование необходимости выделения в качестве самостоятельного этапа процесса доказывания - исследование доказательств. В частности, приводятся доводы взаимообусловленности исследования, проверки и оценки в процессе доказывания. Автором представлен взгляд о том, что полноценной проверке и оценке доказательств предшествует их исследование. Без познания сведений, подлежащих доказыванию, без изучения их содержательной части, невозможно говорить о полноценности процесса доказывания по уголовному делу.

On the question of the need for legislative regulation of the study of evidence as a full-fledged stage of the proof process

This article provides a rationale for the need to allocate as an independent stage of the process of proof - the study of evidence. In particular, the arguments of the interdependence of research, verification and evaluation in the process of proof are presented. The author presents the view that the full verification and evaluation of evidence is preceded by their study. Without knowledge of the information to be proved, without studying their content, it is impossible to talk about the usefulness of the process of proof in a criminal case.
