ПРОБЛЕМЫ ПРИВЛЕЧЕНИЯ К ОТВЕТСТВЕННОСТИ ЗА НЕИСПОЛНЕНИЕ ОБЯЗАННОСТЕЙ ПО ВОСПИТАНИЮ НЕСОВЕРШЕННОЛЕТНЕГО

Функцию воспитания подрастающего поколения государство адресует законным представителям. Однако, не все выполняют данную обязанность добросовестно, защищая ребенка. По неисполнению обязанностей по воспитанию несовершеннолетнего (ст. 156 Уголовного кодекса Российской Федерации (далее - УК РФ) возбуждается большое количество уголовных дел ежегодно. Ст. 156 УК РФ устанавливает уголовную ответственность названных лиц за неисполнение или ненадлежащее исполнение обязанностей по воспитанию несовершеннолетних. Данная норма является бланкетной, поскольку обязанность родителей по воспитанию детей закреплена в Конституции Российской Федерации (ст. 38) и СК РФ (ст. 63).

The state assigns the function of educating the younger generation to legal representatives. However, not everyone fulfills this duty in good faith, protecting the child. For failure to fulfill the obligations of raising a minor (Article 156 of the Criminal Code of the Russian Federation (hereinafter referred to as the Criminal Code of the Russian Federation), a large number of criminal cases are initiated annually. Article 156 of the Criminal Code of the Russian Federation establishes criminal liability of these persons for failure to fulfill or improper fulfillment of obligations for the upbringing of minors. This rule is blanket, since the obligation of parents to raise children is enshrined in the Constitution of the Russian Federation (Article 38) and the RF IC (Article 63).
