ПОНЯТИЯ "ПРАВО ЧЕЛОВЕКА НА ЖИЗНЬ" И "ИНСТИТУТ СМЕРТНОЙ КАЗНИ"

В современном мире и по сей день проблема отмены или применения смертной казни стоит весьма остро. Идут дискуссии, до сих пор, по поводу проблем, касающихся отмены смертной казни. Возникают споры о том, нарушает ли данная мера наказания права человека или же удерживает уровень преступности. Мы знаем, что любой человек - это биосоциальное существо, взгляды на жизнь, принципы и интересы которого формируются под влиянием общества, в котором живет человек. Получается, что социум причастен к тому, что человек может переступить грани и стать преступником, но как наказать того, кто нарушил закон, при этом, сохранить его права, закрепленные в Конституции. В связи с чем, неоднозначно решенный остается вопрос для современных демократических государств: сохранить или отменить смертную казнь. Поэтому актуальность данного вопроса остается неизменной.

In the modern world to this day, the problem of the abolition or application of the death penalty is very acute. Discussions are still going on about the problems concerning the abolition of the death penalty. There are disputes about whether this measure of punishment violates human rights or keeps the crime rate down. We know that any person is a biosocial being, whose views on life, principles and interests are formed under the influence of the society in which a person lives. It turns out that society is involved in the fact that a person can cross the line and become a criminal, but how to punish someone who violated the law, while preserving his rights enshrined in the Constitution. In this connection, the question remains ambiguously resolved for modern democratic states: to preserve or abolish the death penalty. Therefore, the relevance of this issue remains unchanged.
