В статье рассматривается генезис включения проблематики борьбы с изменением климата в международные договоры по правам человека и в деятельность договорных органов по правам человека. Авторами раскрывается динамика вовлечения договорных органов в процесс разъяснения международных обязательств государств по защите прав человека в контексте борьбы с изменением климата. Обозначается тенденция проявления повышенного интереса к процедуре сообщений в договорных органах со стороны экологических активистов в целях защиты их прав на примере жалобы, поданной в Комитет по правам человека жителями островов Торресова пролива против Австралии, а также жалобы группы подростков (включая широко известную экологическую активистку Грету Тунберг) против Аргентины, Бразилии, Германии, Турции и Франции в Комитет по правам ребенка. Авторы делают вывод об имеющемся потенциале договорных органов в сфере дальнейшего усиления взаимосвязи международного права человека и противодействием изменению климата.
The article examines the genesis of integrating climate change issues into international human rights treaties and into the activities of the human rights treaty bodies. The authors revealthe dynamics of the involvement of the treaty bodies in the process of clarifying the international obligations of States to protect human rights in the context of combating climate change. The tendency of increased interest in the communications procedure within the treaty bodies by environmental activists with the aim of protecting their rights is indicated on the basis of the communication lodged to the Human Rights Committee by a group of Torres Strait Islanders against Australia and communication sent to the Committee on the Rights of the Child by a group of teenagers (including the well-known environmental activist Greta Tunberg) against Argentina, Brazil, Germany, Turkey and France. The authors conclude that there is a potential for the treaty bodies to further strengthen the relationship between international human rights law and combating climate change.
