Правовое регулирование административных процедур в Таможенном Кодексе ЕАЭС

В данной статье рассмотрены вопросы соотношения понятий «административной процедуры» и «таможенной процедуры». Приведен краткий анализ административной процедуры в таможенном деле и соотношение представленных правовых институтов в сравнительном аспекте. Изложены научные и законодательные базисы структуры и применения европейской административной процедуры как элемента государственного управления (на примере итальянского законодательства об административных процедурах).

Legal regulations of administrative procedures in customs code of the EAEU

Adduced article considers number of questions of a parity of concepts of "administrative procedure" and "customs procedure". Author presented brief analysis of the administrative procedure in the customs business and the correlation of these legal institutions in a comparative manner. This manuscript examines the doctrinal positions of jurists, which are the only legal binding that is valid. The scientific and legislative bases of the structure and application of the European administrative procedure as an element of public administration are set out (Italian legislation on administrative procedures).
