Борьба с детской порнографией в Интернете: пример Франции

В настоящей статье исследуются проблемы, встающие перед французским обществом, касающиеся усиливающегося объема вовлеченности несовершеннолетних детей в индустрию порнографии. Вместе с тем, авторами рассматриваются, как законодательные нормы противодействия подобным нарушениям прав детей, так и определенные политические меры, принимаемые во Франции, и направленные на борьбу с эксплуатацией детей. Кроме того, сложность поднятой в статье проблематики, усугубляется и фактором распространения материалов детской порнографии в Интернете, что подчас довольно сложно отследить и санкционировать подобные преступления в рамках уголовного законодательства. Особый акцент авторы делают на необходимости исполнения Францией обязательств по международным договорам в сфере защиты прав детей, как универсального, так и регионального характера. По итогам исследования предлагаются конкретные меры по усилению правых механизмов борьбы с детской порнографией во Франции.

Combating child pornography on the Internet: the case of France

The Internet has occupied a significant place in the life of a modern person, as it turned out to be an excellent tool for receiving various information, work and entertainment. However, it can also become a risk zone, especially for the most vulnerable category of the population, children and adolescents. This article explores the problems facing the French society regarding the increasing involvement of under-age children in the pornography industry. At the same time, the authors consider as legislative norms to counteract such violations of children's rights, as well as certain political measures taken in France and aimed at combating the exploitation of children. In addition, the complexity of the issues raised in the article is aggravated by the factor of distributing child pornography materials on the Internet, which is sometimes quite difficult to track down and authorize such crimes under criminal law. The authors emphasize the need for France to fulfill its obligations under international treaties in the field of the protection of children's rights, both universal and regional in nature. The study proposes specific measures to strengthen the right mechanisms to combat child pornography in France. Despite the existence of legislative instruments to counter the spread of child pornography, experts draw attention to the need for other measures aimed at preventing the exploitation of children, such as, for example, parental control over content that falls within the field of view of their children.
