К вопросу о моменте начала жизни человека в теории православия и ислама и уголовных законах России и Турции

В статье рассмотрены проблемные вопросы, связанные с разрешением дискуссионной проблемой о правовом закреплении момента начала жизни человека. Для этого авторы обратились к анализу рассмотрения данной проблемы в теории православия и ислама, а так же закреплению соответствующих фикций уголовных законах России и Турции. Авторы приходит к выводу, что должны произойти качественные изменения имеющихся законодательных подходов Российской Федерации и Турецкой Республики в понимании момента начала жизни человека, так как они не в полной мерее соответствуют морали и религиозным теориям. Предлагается считать, что жизнь человека начинается с момента зачатия, она должна быть защищена всеми моральными и правовыми нормами. Для этого необходимо совершенствование уголовного закона.

The article examines problematic issues related to the resolution of the controversial problem of legal consolidation of the moment of the beginning of human life. To do this, the authors turned to the analysis of the consideration of this problem in the theory of Orthodoxy and Islam, as well as the consolidation of the corresponding fictions in the criminal laws of Russia and Turkey. The authors come to the conclusion that there should be qualitative changes in the existing legislative approaches of the Russian Federation and the Turkish Republic in understanding the moment of the beginning of human life, since they do not fully correspond to morality and religious theories. It is proposed to consider that human life begins from the moment of conception, it must be protected by all moral and legal norms. For this, it is necessary to improve the criminal law.
