О реформе нотариата: от концепции к закону

В статье рассмотрены основные проблемы современного нотариата с учетом представленной Министерством юстиции РФ на публичное рассмотрение в Совете Федерации 6 декабря 2023 г. и 4 апреля 2024 г. концепции нового законопроекта о нотариате. Проанализированы вопросы технико-юридического оформления концепции закона и разработки законопроекта, рассмотрены существенные аспекты организации деятельности нотариата, в частности, увеличение контрольных функций Минюста России, подзаконного регулирования, самофинансирования нотариата, определения понятия «нотариальной деятельности» и другие. Целью данной работы являются обсуждение актуальных проблем в сфере нотариата и предложение конструктивных идей для их решения.

This article examines the main problems of modern notaries, taking into account the concept of a new bill on notaries presented by the Ministry of Justice of the Russian Federation for public consideration in the Federation Council on December 6, 2023 and April 4, 2024. The issues of technical and legal formalization of the concept of the law and the development of the bill are analyzed, significant aspects of organizing the activities of the notary are considered, in particular, the increase in the control functions of the Ministry of Justice of Russia, subordinate regulation, self-financing of the notary, the definition of the concept of “notarial activity” and others. The purpose of this work is to discuss current problems in the field of notaries and propose constructive ideas for solving them. We hope that the suggestions and recommendations will be useful for the development and improvement of notarial activities in modern society.
