ЮРИДИЧЕСКАЯ ДОГМАТИКА: ПОНЯТИЕ И ФОРМЫ

В статье раскрываются понятия «догма права», «юридическая догматика». Автор выявляет типичные формы юридической догматики: правовые конструкции, дефиниции (определения), принципы и догматический метод. В работе уделяется внимание изучению основных этапов становления юридической догматики как науки и процессу её развития: средневековый период, период Нового времени, период, охватывающий ученую юриспруденцию XIX-XXI вв.. Автор приходит к выводу: исследуемое явление - один из основных стилей юридического мышления, который находит свое отражение в специальной правовой терминологии, конструкциях и методах.

The article reveals the concept of "dogma of law", "legal dogma". The author reveals the typical forms of legal dogmatics: legal constructions, definitions, principles and dogmatic method. The paper focuses on the study of the main stages of the formation and development of legal dogmatics as a science: the medieval period, the period of the New Age, the period covering the scientific jurisprudence of the XIX-XXI centuries. The author comes to the conclusion that the phenomenon under study is one of the main styles of legal thinking, which is reflected in special legal terminology, structures and methods.
