ВОЗМОЖНОСТЬ ПРИМЕНЕНИЯ ИНСТИТУТА ПОМОЛВКИ ПРИ ЗАКЛЮЧЕНИИ БРАКА В РОССИЙСКОЙ ФЕДЕРАЦИИ

При подаче заявления о государственной регистрации брака между подавшими его лицами не возникает никаких правоотношений. В связи с этим у них отсутствует правовая защищенность в случае отказа одной из сторон от заключения брака. Для решения данной проблемы предлагается ввести в российское семейное законодательство институт помолвки, широко применяемый в других государствах. Появление в России данного института способствовало бы укреплению традиционных ценностей, семьи и брака. В настоящей статье проводится анализ возможности применения института помолвки в Российской Федерации, исследуются исторические и традиционные основы его введения, а также опыт зарубежных стран, рассматриваются мнения ученых по данному вопросу.

THE POSSIBILITY OF APPLYING THE INSTITUTION OF ENGAGEMENT AT THE CONCLUSION OF MARRIAGE IN THE RUSSIAN FEDERATION

When submitting an application for state registration of marriage, no legal relations arise between the persons who submitted it. In this regard, they have no legal protection in case of refusal of one of the parties from the marriage. To solve this problem, it is proposed to introduce the institution of engagement, widely used in other states, into Russian family legislation. The appearance of this institution in Russia would help strengthen traditional values, family and marriage. This article analyzes the possibility of using the institute of engagement in the Russian Federation, examines the historical and traditional foundations of its introduction, as well as the experience of foreign countries, examines the opinions of scientists on this issue.
