Судебный штраф в уголовном законодательстве РФ

В статье анализируются положения Уголовного кодекса РФ, предоставляющие суду право освободить виновное лицо от уголовной ответственности с назначением судебного штрафа. При применении данных норм выявлены пробелы, в связи с чем складывается противоречивая судебная практика. Также рассмотрены вопросы прекращения уголовного дела в связи с назначением судебного штрафа при отсутствии потерпевшего и ущерба.

Court fine in russian criminal law

The article analyzes the provisions of the criminal code, allowing to exempt from criminal liability a guilty person with the appointment of a measure of criminal law in the form of a court fine. As a result of law enforcement activity of this norms gaps of the current criminal legislation are revealed in connection with which formed a contradictory judicial practice. The problems of termination of the criminal case in connection with the imposition of a court fine in the absence of the victim and compensation for damage caused are also considered.
