Корпоративный контроль за деятельностью стажера адвоката и его дисциплинарная ответственность по законодательству Российской Федерации

В статье исследовано российское законодательство и акты органов адвокатского самоуправления, связанное с регламентацией вопросов корпоративного контроля за деятельностью стажера адвоката, и проблемы его привлечения к дисциплинарной ответственности. Сформулировано предложение об обязанности органов адвокатского самоуправления осуществлять ведение реестра стажеров адвокатов, об уточнении требований, предъявляемых к адвокату-куратору, и о выплате ему вознаграждения, а также о необходимости распространения положений о дисциплинарной ответственности, предусмотренных Кодексом профессиональной этики адвоката, на стажера адвоката.

Corporate control of activity of the trainee attorney and his disciplinary responsibility under the legislation of the Russian Federation

This article contains the analysis of the Russian legislation and acts of bodies of attorney's self-government related to a regulation of matters of corporate control of activity of the trainee attorneys and a problem of bringing him to a disciplinary responsibility. The article provides the suggestion about an obligation of bodies of attorney's self-government to maintain the register of trainee attorneys, about specification of requirements imposed to the attorney-curator and about payment of remuneration to it and in addition, about need of application of the regulations on disciplinary responsibility provided by the Code of professional ethics for attorneys (KPEA) to the trainee attorney.
