ЗАЩИТА ПРАВА НА БЛАГОПРИЯТНУЮ ОКРУЖАЮЩУЮ СРЕДУ В ПРАКТИКЕ ЕВРОПЕЙСКОГО СУДА ПО ПРАВАМ ЧЕЛОВЕКА

Статья посвящена актуальной проблеме защиты права на благоприятную окружающую среду на основании Европейской конвенции о защите прав человека и основных свобод (ЕКПЧ). Нарушение этого права не является самостоятель ным основанием для обращения в Европейский суд по правам человека (ЕСПЧ), однако фактически косвенно обеспечивается посредством прецедентного права ЕСПЧ, которое в настоящее время активно развивается. В связи с этим, наравне с практикой ЕСПЧ по делам о защите права на благоприятную окружающую среду, в статье анализируется Рекомендация ПАСЕ о разработке дополнительного, пятнадцатого Протокола к ЕКПЧ о праве на здоровую и жизнеспособную окружающую среду.

PROTECTION OF THE RIGHT TO A FAVORABLE ENVIRONMENT IN PRACTICE OF THE EUROPEAN COURT OF HUMAN RIGHTS

The article is devoted to a topical problem of protection of the right to a favorable environment under the European Convention for the Protection of Human Rights and Fundamental Freedoms (ECPHR). Infringement of this right is not a separate cause to apply to the European court of human rights (ECHR), however, it is actually indirectly ensured through the case law of ECHR, which actively develops now. In this connection, along with the practice of ECHR on cases concerning protection of the right to a favorable environment, the article analyzes the PACE (Parliamentary Assembly of the Council of Europe) Recommendation on an additional, fifteenth, protocol to ECPHR concerning the right to a healthy and viable environment.
