До этого момента единственным источником правового регулирования арбитража в США были судебные прецеденты, а федеральные суды неохотно принуждали стороны к арбитражному разрешению споров на основании арбитражных соглашений. Действующая с 1925 года «проарбитражная» политика США в настоящее время становится все более и более агрессивной. Примером этого служит решение по делу «GE Energy Power Conversion France SAS, Corp v. Outokumpu Stainless USA, LLC» от 01.06.2020, в котором Верховный суд США единогласно постановил, что Нью-йоркская конвенция 1958 г. не препятствует принуждению стороны, не подписавшей арбитражное соглашение, к арбитражному разбирательству на основании эстоппеля по праву справедливости.
The article notes that the adoption of the Federal Arbitration Act (FAA) in the USA in 1925 marked the recognition of the advantages of arbitration and established a national policy favorable to arbitration. Up to this point, the only source of legal regulation of arbitration in the United States were judicial precedents, and federal courts were reluctant to force the parties to arbitrate disputes on the basis of arbitration agreements. The "pro-arbitration" policy of the United States, which has been in force since 1925, is now becoming more and more aggressive. An example of this is the decision in the case "GE Energy Power Conversion France SAS, Corp v. Outokumpu Stainless USA, LLC" dated 01.06.2020, in which the US Supreme Court unanimously ruled that the New York Convention of 1958 does not prevent the coercion of a party that has not signed an arbitration agreement to arbitration on the basis of estoppel by right of equity.
