ПРЕЗУМПЦИЯ СОГЛАСИЯ И НЕСОГЛАСИЯ В ПРОЦЕДУРАХ ИЗЪЯТИЯ ЧЕЛОВЕЧЕСКИХ ОРГАНОВ

В данной статье анализируется юридическое оформление дачи согласия донором в процедурах изъятия человеческих органах в Российской Федерации, США и Великобритании. Рассматриваются презумпция согласия и презумпция несогласия в указанных процедурах. Сравнивается их применение в различных странах, приводятся аргументы «за» и «против» их применения.

PRESUMED CONSENT AND EXPRESS CONSENT IN HUMAN ORGAN TRANSPLANTATION PROCEDURES

The research goal of this article is to analyse legal formalization of donor consent in the removal of human organs procedures in the Russian Federation, the USA and the UK. Moreover, presumed consent and express consent in human organ transplantation procedures are the objects of studying of the article. Their application in different countries is compared and arguments for and against their using are given.
