Правовые особенности применения соглашения об уплате алиментов на несовершеннолетних детей во Франции

Законодательство Франции детально регламентирует ряд способов (число которых больше, чем во многих других государствах) добровольного заключения родителями соглашений об уплате алиментов на несовершеннолетних детей, что способствует максимальному соблюдению не только прав несовершеннолетних детей, но и интересов их родителей. Изучение опыта регулирования и применения института добровольной уплаты алиментов на несовершеннолетних детей по соглашению родителей может способствовать реформированию отечественного профильного законодательства. В статье рассмотрены ключевые аспекты, связанные с различными способами добровольного закрепления родителями порядка и гарантий уплаты алиментов: соглашение родителей, утвержденное судом; соглашение о разводе или о раздельном проживании супругов; нотариально заверенное соглашение; соглашение, которому учреждение, ответственное за семейные пособия, предоставило право принудительного исполнения.

The article aims to study the legal features of applying child support agreements in France. It points out that French legislation regulates in detail a number of ways (the number of which is more than in many other states) of the voluntary conclusion of child support agreements by parents, which contributes to the maximum observance of not only the rights of minors, but also the interests of their parents. The author of the article pays special attention to the fact that the study of the experience of the regulation and application of the institution of the voluntary payment of child support can contribute to the reform of the specialised legislation of the Russian Federation. The article makes an attempt to discuss the key aspects associated with various methods of voluntary consolidation of the order and guarantees for the payment of child support by parents. These methods include parents' agreements, approved by the court; agreements on divorce or separation of spouses; notarised agreements; agreements according to which the agency responsible for family benefits granted the right of enforcement. It seems that certain aspects of the French experience in regulating and applying voluntary child support agreements between parents can be adapted and implemented into the legislation of the Russian Federation.
