РАЗРЕШЕНИЕ СПОРОВ И ИСКУССТВЕННЫЙ ИНТЕЛЛЕКТ: ЗА И ПРОТИВ

В статье отмечено, что впервые в феврале 2019 г. в Высоком суде Англии и Уэльса в порядке медиации решение было вынесено искусственным интеллектом - «роботом-ме-диатором». Однако В. Момотов, председатель Совета судей РФ, неоднократно заявлял, что говорить о замене судьи искусственным интеллектом как минимум преждевременно, а скорее всего, невозможно. Авторы статьи не согласны с этим утверждением и полагают, что, напротив, надо возглавить и направить работу по внедрению пилотных проектов в сфере ИИ в разрешении споров, а также по нормативному регулированию этого сложного вопроса. Запретить использование ИИ в медиации, тем более в коммерческой медиации, уже невозможно. Российскому законодателю нужно быть готовым к этому и создавать законы в сфере искусственного интеллекта в медиации. Необходимо создавать российских роботов-медиаторов и учить их российским ценностям и интересам.

Momotov, chairman of the Council of Judges of the Russian Federation, has repeatedly stated that talking about replacing a judge with artificial intelligence is at least premature, but most likely impossible. The authors of the article do not agree with this statement. The authors believe that, on the contrary, it is necessary to lead and direct work on the implementation of pilot projects in the field of AI in the resolution of disputes, as well as on the regulatory regulation of this complex issue. To prohibit the use of AI in mediation, especially in commercial mediation, is no longer possible. Therefore, the Russian legislator needs to be prepared for this. It is necessary to create laws in the field of artificial intelligence in mediation. It is necessary to create Russian robots-mediators and teach them Russian values and interests.
