ПРАВОВЫЕ ПОСЛЕДСТВИЯ НЕСООТВЕТСТВИЯ УСТАВА ВЫСШЕГО УЧЕБНОГО ЗАВЕДЕНИЯ ПОЛОЖЕНИЯМ ЗАКОНА

Работа посвящена анализу правовых последствий несоответствия положений устава высшего учебного заведения положениям действующего законодательства. Автором анализируется научная литература и правоприменительная практика, по результатам чего выявляются возможные способы реакции правовой системы на такое несоответствие. В работе отмечается разнообразие возможных мер устранения противоречий устава высшего учебного заведения положениям закона, что зависит от характера таких противоречий и конкретных обстоятельств.

The article is devoted to the analysis of the legal consequences of the inconsistency of the provisions of the charter of a higher educational institution with the provisions of current legislation. The author analyzes the scientific literature and law enforcement practice, as a result of which possible ways of the legal system's reaction to such a discrepancy are identified. The paper notes the variety of possible measures to eliminate contradictions in the charter of a higher educational institution with the provisions of the law, which depends on the nature of such contradictions and specific circumstances.
