Реализация судебной реформы 1864 г. на территории Российской Империи

В статье аспирантки кафедры теории и истории государства и права Российского университета дружбы народов Л.С. Нестеренко рассматриваются основные этапы реализации cудебной реформы 1864 г. на территории Российской империи, а также предпринята попытка выявить основные тенденции в политике правительства в данный период и выяснить степень ограничения основных начал судебной реформы законодательством, принятым в дополнение к уставам 1864 г. В настоящее время в России в очередной раз предпринимаются попытки привести право, политику, образование в соответствие с европейскими стандартами. При этом, несомненно, нужно опираться не только на современный, но и исторический опыт. Таким образом, изучение судебной реформы 1864 г., ее обретений и просчетов является весьма актуальной задачей.

The implementation of judicial reform of 1864 in territory of the Russian Empire

In article of the post-graduate student of the chair of theory and history of state and law of the Peoples` Friendship University of Russia L.S. Nesterenko (e-mail:) the basic halting place of realization judicial reforms of 1864 in territory of the Russian Empire are considered, and also attempt to reveal the basic tendencies in the politician of the government during the given period is undertaken, and to find out degree of limitation of the basic beginnings of judicial reform by the legislation accepted in addition to charters of 1864. In present time in Russia once again attempts to result the law, a policy and education in conformity with the European standards are undertaken. Thus, undoubtedly, it's necessary to lean not only on modern, but also against historical experience. Thereupon studying of judicial reform of 1864, its findings and miscalculations, is rather actual problem.
