Правовые проблемы недропользования Арктики

Арктика в XXI в. является одним из важнейших регионов Земли с точки зрения наличия природных ископаемых, находящихся в ее недрах. Именно этим фактом вызван повышенный интерес к данному региону со стороны как арктических, так и неарктических государств. Особое значение в связи с этим приобретают проблемы защиты уязвимой природной среды при добыче полезных ископаемых и их транспортировке, а также установление эффективного международного сотрудничества государств при реализации правового режима использования Арктической зоны. В данной работе были проанализирована правовая база недропользования, транспортировки добытых ископаемых, международное сотрудничество государств в рассматриваемом регионе, эффективность деятельности специально учрежденных органов и неизбежный экологический вред как результат недропользования. Статья содержит предложения относительно разрешения существующих, по мнению автора, важных проблем правового регулирования природопользования в Арктике. Целью настоящей статьи является выявление актуальных вопросов, связанных с предотвращением экологического вреда в Арктическом регионе в рамках правового режима недропользования на национальном и международном уровне.

The Arctic in the 21st century is one of the most important regions of the Earth in terms of the availability of natural resources located in its bowels. It is this fact that has caused increased interest in this region from both Arctic and non-Arctic states. Of particular importance, in this regard, are the problems of protecting the vulnerable natural environment during the extraction of minerals and their transportation, as well as the establishment of effective international cooperation between states in the implementation of the legal regime for the use of the Arctic zone. In this work, the legal framework of subsurface use, transportation of extracted minerals, international cooperation of states in the region under consideration, the effectiveness of the activities of specially established bodies and the inevitable environmental harm as a result of subsurface use were analyzed. The article contains proposals regarding the resolution of the existing, in the author’s opinion, important problems of legal regulation of environmental management in the Arctic. The purpose of this article is to identify topical issues related to the prevention of environmental harm in the Arctic region within the framework of the legal regime of subsoil use at the national and international level.
